IN exercise of the powers conferred by subsection (4) of section 39 of the Copyright Act 1987, the Minister makes the following regulations: Citation and Commencement 1. These Regulations may be cited as the Copyright (Notice of Prohibition of Import) Regulations 1987 and shall come into force on the 2nd December 1987. Interpretation 2. In these Regulations, unless the context otherwise requires— “import” means to bring or cause to be brought into Malaysia by whatever means; “notice” means notice under subsection (1) of section 39 of the Act. Notice 3.—(1) The notice shall be in the form set out in Part I of the Schedule and shall be deemed to have been served on the Minister if the owner of the copyright in the work has served such notice on the Controller in the manner prescribed under these Regulations. (2) A separate notice shall be given in respect of each work. Further Notice 4.—(1) The owner of the copyright in the work may give another notice in the form set out in Part II of the Schedule where he knows or has reason to believe that the prohibited copies are about to be imported into Malaysia. MY034EN Copyright (Notice of Prohibition of Import), Regulations, 1987 page 2/6 (2) Such notice shall be deemed to have been served on the Minister if the owner of the copyright in the work has served such notice on the Controller in the manner prescribed under these Regulations. (3) A separate notice shall be given in respect of each importation, whether of one or more works. Service of Notice 5.—(1) Every notice shall be duly completed in quadruplicate and shall be served by delivering it in person or by sending it by registered post to the Controller. (2) Every notice shall be accompanied by satisfactory proof of ownership of the copyright to the work. Fee on the Service of Notice 6. A fee of one hundred ringgit in respect of each notice shall be paid to the Controller at the time the notice is given. Change of Ownership 7.—(1) The owner of the copyright in any work who has given a notice shall notify the Controller in writing of any change in the ownership of the work or of any other change affecting the notice within twenty eight days of such change. (2) The notice shall be deemed to be withdrawn as from the expiry of twenty eight days from such change. Security or Further Security 8.—(1) The owner of the copyright in any work, who has given a notice shall give to the Controller such security or further security, whether by bond, deposit of a sum of money or otherwise, as the Controller may require, against all actions, proceedings, claims and demands whatsoever which may be taken or made against the Controller and shall pay to the Controller all costs and expenses which may be incurred by the Controller in consequence of the detention of, or anything done in relation to, any copy of a work to which the notice relates. (2) The security or further security shall be given at such time and in such manner as the Controller may require. If such security or further security is not given within the time or in the manner required by the Controller, the notice shall be deemed to have been withdrawn as from the expiry of the time the security or further security is required to be given. The owner of the copyright in any work, or his agent, who has given a notice shall, either at the time of giving the notice or at the time of giving further notice, or at both such times, furnish to the Controller such evidence and information within such time and in such form as the Controller may require, and shall produce within such time as the Controller may specify such books or other documents as the Controller may require. If such evidence and information are not furnished and if such books or other documents are not produced as required by the Controller, the notice shall be deemed to have been withdrawn as from such time as the Controller shall specify. Owner of Copyright to Keep the Controller Indemnified Against all Actions, Proceedings, Claims and Demands 10. Where— (a) the notice is withdrawn or deemed to have been withdrawn; or (b) security has not been required by the Controller, the owner of the copyright in any work shall keep the Controller indemnified against all actions, proceedings, claims and demands whatsoever which may be taken or made against the Controller and shall repay to the Controller all costs and expenses which may be incurred by the Controller in consequence of the detention of, or anything done in relation to, any copy of a work to which the notice relates. Any such costs and expenses may be recovered as a debt due to the Government. (3) 하나 이상의 저작물인지 여부에 관계없이 각 수입에 대해 별도의 통지를 해야 한다. 통지 송달 5.—(1) 모든 통지는 4부로 정식으로 작성되어야 하며, 직접 전달하거나 등기 우편으로 관리인에게 보내어 송달해야 한다. (2) 모든 통지에는 해당 저작물에 대한 저작권 소유권에 대한 만족스러운 증거가 첨부되어야 한다. 통지 송달 수수료 6. 각 통지에 대해 100링깃의 수수료를 통지 제공 시 관리인에게 지불해야 한다. 소유권 변경 7.—(1) 통지를 제공한 저작물의 저작권 소유자는 해당 변경 사항 발생 후 28일 이내에 해당 저작물의 소유권 변경 또는 통지에 영향을 미치는 기타 변경 사항을 서면으로 관리인에게 통지해야 한다. (2) 해당 통지는 해당 변경 사항으로부터 28일이 만료되는 시점부터 철회된 것으로 간주된다. 담보 또는 추가 담보 8.—(1) 통지를 제공한 저작물의 저작권 소유자는 관리인에게 제기되거나 제기될 수 있는 모든 소송, 절차, 청구 및 요구에 대해 관리인이 요구할 수 있는 담보 또는 추가 담보(채권, 금전 예치 또는 기타 방식)를 관리인에게 제공해야 하며, 해당 통지와 관련된 저작물의 사본의 구금 또는 관련하여 수행된 모든 행위의 결과로 관리인이 발생할 수 있는 모든 비용 및 경비를 관리인에게 지불해야 한다. (2) 담보 또는 추가 담보는 관리인이 요구할 수 있는 시기와 방식으로 제공해야 한다. 해당 담보 또는 추가 담보가 관리인이 요구하는 시간 또는 방식으로 제공되지 않은 경우, 해당 통지는 담보 또는 추가 담보를 제공해야 하는 시간이 만료되는 시점부터 철회된 것으로 간주된다. MY034EN 저작권(수입 금지 통지), 규정, 1987년 페이지 3/6 저작권 소유자의 증거 등 제공 9. 통지를 제공한 저작물의 저작권 소유자 또는 그의 대리인은 통지 제공 시 또는 추가 통지 제공 시 또는 양쪽 시점에 관리인이 요구할 수 있는 시간 내에 그리고 관리인이 요구할 수 있는 형식으로 해당 증거 및 정보를 관리인에게 제공해야 하며, 관리인이 지정할 수 있는 시간 내에 관리인이 요구할 수 있는 장부 또는 기타 문서를 제출해야 한다. 해당 증거 및 정보가 제공되지 않고 해당 장부 또는 기타 문서가 관리인이 요구하는 대로 제출되지 않은 경우, 해당 통지는 관리인이 지정하는 시점부터 철회된 것으로 간주된다. 저작권 소유자의 모든 소송, 절차, 청구 및 요구에 대한 관리인 면책 의무 10. 다음의 경우— (a) 통지가 철회되거나 철회된 것으로 간주되는 경우; 또는 (b) 관리인이 담보를 요구하지 않은 경우, 저작물의 저작권 소유자는 관리인에게 제기되거나 제기될 수 있는 모든 소송, 절차, 청구 및 요구에 대해 관리인을 면책해야 하며, 해당 통지와 관련된 저작물의 사본의 구금 또는 관련하여 수행된 모든 행위의 결과로 관리인이 발생할 수 있는 모든 비용 및 경비를 관리인에게 상환해야 한다. 해당 비용 및 경비는 정부에 대한 부채로 회수될 수 있다.
